1. APPLICABILITY OF THE TERMS OF SALE

1.1. Terms of sale apply to goods purchased from VärvX OÜ (registry code 11370349; legal address: Miku tee 11, Ahisilla Village, Kose Parish, 75111 Harju County; phone number +372 524 3036 and e-mail info@varvx.ee). 1.2. In addition to these terms, the legal relations arising from the purchase of products from the varvx.ee online store are regulated by the laws in force in the Republic of Estonia, including Law of Obligations Act (hereinafter: LOA), Consumer Protection Act (hereinafter: CPA) and other legislation. 1.3. The varvx.ee online store reserves the right to make changes to the terms of sale. Such changes shall be published on the website www.varvx.ee.

2. PRICES

2.1. The goods will be sent to an Omniva or Itella Smartpost parcel terminal or transported to your home by a courier according to the service provider’s price list. Read more about delivery in section 4 and under the link ‘Delivery’. 2.2. Legal relationships between the buyer and the varvx.ee online store arising from orders submitted before changes to the terms of sale or prices shall be handled according to the terms which applied during the finalisation of the order. 2.3. The varvx.ee online store reserves the right to make changes in sales prices. Such changes shall be published on the website www.varvx.ee. 2.4. All the prices are in euros.

3. PAYMENT METHODS

3.1. In the varvx.ee online store it is possible to pay with Swedbank, SEB, Luminor, LHV, Coop Pank and PocoPay bank links. 3.2. All payments are made in euros and deducted from the payer’s account in euros. 3.3. Payments with bank links are mediated by Maksekeskus AS on the basis of an agreement. 3.4. The online store is the controller of personal data. The online store transmits personal data which are necessary for making payments to the data processor Maksekeskus AS.

4. DELIVERY

4.1. We deliver goods within Estonia. 4.2. Shipping costs are borne by the buyer. 4.3. Options for receiving the goods: – picking up the goods yourself; – delivery to the place desired by the buyer, using the services of the following courier companies: Jet Express, EstFin Trans, DPD Kuller, Kaubaekspress. 4.4. Shipments usually reach the destination specified by the buyer within thirty (30) calendar days. If the customer has special requests for the product finishing, within sixty (60) calendar days.

5. ORDER FINALISATION

5.1. Add the desired products to the shopping cart. 5.2. To place the order, click on the ‘Proceed to payment’ link in the shopping cart. 5.3. Take care to fill in the required data fields correctly on the order confirmation page, since fast and seamless delivery and later settlement of any possible disputes and complaints are dependent on the correctness of the provided information. When registering a customer account, information about it will be sent to the e-mail address indicated in the data. 5.4. Confirm that you have read and agree to the terms of sale, and place the order by clicking on the corresponding button. 5.5. The invoice awaiting payment will be displayed. You can view the invoice at any time by logging in to your customer account. The invoice will also be sent to the e-mail address indicated in the customer’s data. 5.6. Orders submitted through the online store are processed on business days (Mon–Fri 10.00–18.00). Orders submitted on Friday after 15.00 will be processed on the following Monday.

6. ENTRY INTO FORCE OF THE CONTRACT OF SALE

6.1. According to the contract for the sale of goods, the varvx.ee online store undertakes to hand over the existing goods or the goods to be acquired by the varvx.ee online store in the future to the buyer and make it possible to transfer ownership to the buyer. The buyer undertakes to pay to the varvx.ee online store the amount indicated in the invoice submitted to them for the goods and to accept the goods. 6.2. The contract of sale shall enter into force after receipt of the payment from the buyer to the bank account of the varvx.ee online store.

7. RIGHT OF WITHDRAWAL

7.1. After receiving the ordered goods, the buyer has the right to withdraw from the sales contract concluded with the online store within fourteen (14) days. In the case of withdrawal from the contract, the consumer must return the purchased item immediately, but no later than within fourteen (14) days after the notification of withdrawal from the contract. 7.2. VärvX OÜ undertakes to return all fees received from the consumer for the returned goods to the buyer immediately, but no later than within fourteen (14) days after receiving the notice of withdrawal, provided that the consumer has returned the goods within the same term, i.e. within fourteen (14) days. This includes, among other things, the cost of delivering the returned product. 7.3. Returned products must be complete. In the event of the deterioration of the returned goods, the consumer shall only be liable for the reduction in the value of the goods due to usage if they have used the goods in any way other than that which is necessary to establish the nature, characteristics and functioning of the goods. In order to establish the nature, characteristics and functioning of the goods, the consumer should only handle and use the goods in the same manner as they would customarily be allowed to do in a regular store. 7.4. If the consumer has chosen a method of delivery other than the cheapest normal method of delivery offered by the trader, the trader shall not be required to reimburse the consumer for any costs which exceed the costs associated with the normal method of delivery. 7.5. The right of withdrawal does not apply to legal persons. 7.6. Upon receipt of the goods, the buyer must make sure that the packaging is intact. Before signing the accompanying document, make sure that the packaging of the goods is intact. Subsequent claims will not be satisfied. The returned goods must be unused, complete and in the original packaging, the packaging must not be broken or damaged. In order to establish the nature, characteristics and functioning of the goods, the buyer should only handle and use the goods in the same manner as they would customarily be allowed to do in a regular store. 7.7. In order to return the goods, an application for withdrawal from the purchase of the goods must be submitted, which can be made in a free form and sent to the e-mail address info@varvx.ee. In the withdrawal application, please indicate the products to be returned, the reason for the return, the buyer’s first and last name and the order number. 7.8. The online store has the right to withdraw from the sales transaction and require the buyer to return the goods, if the price of the goods was marked significantly below the market value of the goods due to an error.

8. FORCE MAJEURE

8.1. The varvx.ee online store shall not be liable for any damage caused to the buyer or delays in delivery, if the damage or delay is due to circumstances which are outside the control of the varvx.ee online store or which could not be foreseen.

9. SUBMISSION OF COMPLAINTS

9.1. A two-year term for submitting a claim provided for in subsection 218 (2) of the LOA applies to the products sold by the varvx.ee online store. 9.2. In the event of a defect, the buyer must submit a claim to the varvx.ee online store no later than within two (2) months of the defect occurring, adding digitally or on paper the invoice on the basis of which the purchase of the goods was paid for. 9.3. The varvx.ee online store is not responsible for: – product defects that have arisen due to the buyer’s fault as a result of non-compliance with the product manual, or improper use and storage of the product; – normal wear of the product. 9.4. Upon discovery of a non-conformity or defect of a product, please submit a complaint by e-mail to info@varvx.ee, indicating the name and phone number of the person who submitted the order as well as the order number and a detailed description of the deficiency or non-conformity of the product. 9.5. All complaints shall be reviewed and the buyer shall be contacted as soon as possible, but no later than fourteen (14) days following the receipt of the complaint.

10. BUYER’S RIGHT TO TURN TO THE CONSUMER DISPUTE RESOLUTION PLATFORM OF THE EUROPEAN UNION

10.1. If the buyer has any complaints about the online store, they must be sent by e-mail to info@varvx.ee. 10.2. If the buyer and the online store are unable to settle the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The terms for the procedures can be found and applications can be submitted HERE. The Consumer Disputes Committee has jurisdiction to settle any disputes arising from contracts concluded between a buyer and an online store. Buyer complaints are reviewed by the Committee free of charge. 10.3. Buyers may also turn to the consumer dispute resolution platform of the European Union.
